Article 1. Scope
These terms and conditions of sale (the “T&Cs”) apply without restriction or reservation to all sales concluded by MAISON MAYOR LE SHOP, a simplified joint-stock company (SAS) with share capital of €1,000, registered with the Montpellier Trade and Companies Register under number 901 050 401 (SIRET 901 050 401 00016), with its registered office at 40 allée Alberto Giacometti, 34000 Montpellier (the “Seller”), to non-professional buyers (the “Customer”) wishing to purchase the products sold on the website www.maisonmayor.com (the “Site”).
The products shown on the Site may only be ordered by customers residing in mainland France and Corsica. The T&Cs are enforceable against the Customer, who acknowledges, by ticking the box provided for this purpose, having read and accepted them before placing an order. Validating the order constitutes acceptance of the T&Cs in force on the day of the order. The Seller reserves the right to amend the T&Cs; the applicable version is the one in force on the day of the order, with no retroactive effect.
Article 2. Definitions
“Order”: the Customer's purchase order. “Site”: www.maisonmayor.com. “Product”: a product offered for sale on the Site. “Customer”: an adult individual acting as a consumer. “Seller”: the company MAISON MAYOR LE SHOP. “Made-to-measure work”: any item produced on request and according to the Customer's instructions; a margin of 1 to 2 cm on hems must be tolerated, as fabrics may stretch or shrink depending on their properties.
Article 3. Description of the products
The technical description states the product's essential characteristics. The photographs, graphics and configurator visuals are not contractual and cannot guarantee a perfect match with the exact shade of the product (screens may display colours differently). To be sure of a shade, ordering a sample is recommended. No claim may be accepted regarding a difference in shade between different dye baths or production batches.
Made-to-measure products include: curtains and sheers, rods and tracks, blinds, and cushions (depending on the options). Standard products include: predefined cushions and decorative objects. Dimensional tolerance margins: curtains and sheers +/- 1 cm (height); rods +/- 1 cm (length); cushions +/- 1 cm (measured flat, without filling); wooden Venetian blinds +/- 1 cm (finished height and width excluding the pelmet). Textile dimensions may change with care and humidity: this is normal and inherent to natural fibres.
Article 4. Sale price
All prices are shown in euros (€) including tax and are paid in euros. The price is set according to the characteristics of the products ordered, at the rate in force on the day the order is validated. It includes the purchase price including tax (at the VAT rate in force) and the eco-contribution, as well as any fees related to the payment method. Any delivery costs are shown separately and added before the order is confirmed (see the “Delivery and shipping costs” article). The company is registered with the National Distance Selling Register under number 47.91B (Éco-mobilier membership).
Article 5. Offer
Offers are reserved for customers residing in mainland France (including Corsica), for deliveries within these areas. They are valid as long as the prices are displayed and the products appear in the catalogue. Acceptance of the offer is confirmed by confirming the order (double-click process).
Article 6. Orders
To order, the Customer reviews the products' characteristics (and, where applicable, sets the made-to-measure dimensions), logs in or registers, validates the order and accepts the T&Cs, then pays the full price including shipping. The sale is firm and final once the confirmation email has been sent. Orders are processed Monday to Friday from 9 am to 5 pm, excluding public holidays. Any change after confirmation is subject to the Seller's agreement. A confirmed order cannot be cancelled, except under the right of withdrawal (Article 11) or in cases of force majeure.
Article 7. Availability
Products are offered while stocks last. In the event of unavailability after the order, the Customer is informed by email and chooses between delivery of an equivalent product, a refund within thirty (30) days, or a change to the delivery time.
Article 8. Payment and security
Payment is made in full at the time of order, at the Customer's choice by bank card (Visa, Carte Bleue, Mastercard) via the secure Payplug platform (CIC Bank), in 3 or 4 instalments via Oney Bank, by bank transfer, or via Apple Pay. The order is only validated once payment has been received. Bank details are protected by SSL encryption and do not pass through the Site. Oney 3x/4x payment is reserved for adult individuals residing in France, for purchases from €100 to €3,000, subject to approval by Oney Bank.
Article 9. Retention of title
Ownership of the products transfers to the Customer only after full payment of the price, regardless of the delivery date.
Article 10. Delivery and shipping costs
Lead times run from the actual receipt of payment. The times indicated are average dispatch times in working days and do not constitute a contractual commitment; any delays do not give rise to damages. Shipping is a flat €35 incl. tax in mainland France (Corsica included), whatever the order amount; samples are free. Collection at our Montpellier showroom is free. Deliveries outside mainland France, in particular to Dubai and the United Arab Emirates, are quoted on a case-by-case basis. In the event of an incident during transport, it is the Customer's responsibility to make explicit reservations on the delivery note or to refuse the delivery.
Article 11. Right of withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for made-to-measure or personalised products: curtains, sheers, tracks, rods and blinds are therefore excluded from the right of withdrawal. For standard products (cushions and décor), the Customer has a period of fourteen (14) clear days from receipt. The request is made by email to shop@maisonmayor.com or by post to: MAISON MAYOR LE SHOP, 40 allée Alberto Giacometti, 34000 Montpellier, stating the order number. Products must be returned in perfect condition, complete, in their original packaging. The refund is made no later than fourteen (14) days after receipt of the returned products, using the same payment method.
Article 12. Liability
The Seller cannot be held liable for non-performance due to the Customer, to the unforeseeable act of a third party, or to force majeure. The nature of the Internet does not allow uninterrupted availability or integrity to be guaranteed; the service may be temporarily interrupted for maintenance.
Article 13. Warranties
All products benefit from the legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code). The warranty does not cover damage resulting from failure to observe the instructions for use, abnormal use, assembly errors by the Customer, or professional use. For textiles, dimensional variations linked to humidity are tolerated and considered normal.
Article 14. Personal data
The personal data requested is necessary to process the order and for invoicing. In accordance with the GDPR and the French Data Protection Act, the Customer has the right to access, modify, rectify, object to, port and restrict the processing of their information. See our privacy policy.
Article 15. Dispute resolution and mediation
In the event of a dispute, the parties will endeavour to find an amicable solution. Failing this, the consumer may refer the matter free of charge to the consumer mediator AME CONSO (Association des Médiateurs Européens) within one year of their written complaint: www.mediationconso-ame.com or 11 place Dauphine, 75001 Paris. The Customer may also use the European online dispute resolution platform (ec.europa.eu/consumers/odr).
Article 16. Governing law
Contracts concluded via the Site are governed by French law. Disputes fall under the jurisdiction of the competent courts in accordance with ordinary law.
Article 17. Intellectual property
The content of the website www.maisonmayor.com is the property of the Seller and its partners, protected by intellectual property law. Any total or partial reproduction is strictly prohibited.
Article 18. References
The Customer authorises the Seller to mention their name and/or logo as a reference in its communication materials, unless they expressly object.
